1. Who provides the service

2. What Symbiote is

Symbiote is a marketing platform: content, SEO, ads, social media, email, online shop and reports, for one or more brands. The free tools can be used without an account and come with no warranty.

3. Your account

• You use the service on behalf of a business or as a professional, and you are at least 18.
• Your account details must be accurate, and your password must be kept secret.
• You are responsible for what the members you invite do in the account.

4. Plans, free trial and payment

• Plans, limits and prices are those on the Pricing page when you choose them.
• The free trial needs no card and ends on its own unless you choose a paid plan.
• Subscriptions are paid in advance, monthly or yearly, through Stripe, and renew automatically until you cancel them in Plan and billing. Cancelling takes effect at the end of the period already paid.
• Prices shown exclude VAT; the invoice shows the VAT that applies.
• You pay ad budgets directly to the ad platforms (Google, Meta and others), not to us.

5. What you must not do

• Send spam or emails without a legal basis, or break the rules of the connected platforms.
• Publish content that is illegal, misleading or infringes the rights of others.
• Try to access other accounts' data, get around your plan's limits or overload the service.
• Use the tools to analyse other people's sites or services abusively.

6. Your content

The content you upload or create remains yours. You give us only the right to store, process and publish it as far as needed to provide the service. AI-generated text and images can contain mistakes: you review them before publishing and you are responsible for what you publish.

7. Connected platforms

Connections to Google, Meta and other platforms are also subject to their own terms. We are not responsible for their changes, limits or outages.

8. Availability and changes to the service

We aim to keep the service available at all times, but there may be interruptions for maintenance or technical reasons. We may improve or change features; we announce in advance any change that reduces your rights.

9. Liability

The service is provided "as is". We do not guarantee specific results, such as Google rankings or sales. To the extent the law allows, our total liability is limited to the amounts you paid in the last 12 months, and we are not liable for indirect losses.

10. Closing your account

You can close your account at any time. We may suspend or close an account that breaks these terms, after telling you, except in serious or urgent cases. After closing, data is deleted as described in the privacy policy.

11. Personal data

How we process personal data is explained in the privacy policy. For your customers' data that you upload to Symbiote we are a processor and process it only on your instructions.

12. Governing law and disputes

These terms are governed by Romanian law. We first try to settle any disagreement amicably, at [contact email]; otherwise disputes go to the competent courts where we are registered. If you are a consumer, you can also contact the Romanian consumer protection authority (anpc.ro).

13. Changes to these terms

When we change the terms we update the date above. We announce important changes by email at least 30 days before they apply.
